Recently, Indecopi declared founded a complaint filed by a group of companies against the Ministry of Health ("MINSA"), ruling that the prohibitions to sell groceries and provide medical consultations in pharmacies and drugstores constitute unreasonable bureaucratic barriers, since such entity did not prove to have previously evaluated the positive and negative impact that these measures generate to the companies obliged to comply with them.

It should be noted that, in accordance with Peruvian regulations on the elimination of bureaucratic barriers, the provisions declared as unreasonable bureaucratic barriers by Indecopi will only be inapplicable to the complaining companies.

Finally, it is important to mention that Indecopi has indicated that the companies benefiting from the decision maintain the obligation to comply with the minimum technical and sanitary conditions established by MINSA in the good practices manuals and other complementary standards.
