On November 5, 2022, Law No. 31601 was published in the Peruvian Official Gazette, which incorporates some amendments to the Code of Consumer Protection and Defense, incorporating literal l) to numeral 1.1 of Article 1 of said Code, referring to consumer rights.

With this incorporation, any provider that offers automated attention through "bots", i.e., digital assistance or artificial intelligence, is obliged to offer the consumer, in addition, the alternative of being assisted by a physical person of his or her choice.

The following is the express text of the incorporation:

 "1.1 Under the terms established by the present code, consumers have the following rights:

(...) l) The right to have the option or alternative of personal attention when the provider offers the public any automated attention system assisted by artificial intelligence or digital assistant".

Additionally, the law becomes effective on November 6, 2022, so we recommend our clients who have bots to implement the changes required by this new regulation.
