On January 7, 2025, Law No. 32230, amending Law No. 29571 – Consumer Protection and Defense Code (the “Law”), was published in the Official Gazette El Peruano. This Law aims to strengthen the Hazardous Products and Services Alert System (the “Alert System”), incorporating the following provisions to ensure consumer safety:
Risk information and warning criteria
- Warnings should be addressed individually to affected consumers. If this is not possible, nationwide mass media should be used, ensuring their effectiveness.
- Mass media warnings must be clear and frequent enough to ensure they reach at-risk consumers.
- Alternative sources of information must be made available, free of charge, and accessible to consumers. This information must also be immediately reported to INDECOPI.
Strengthening the Alert System
The administrative authority shall have the power to:
- Request, verify, and consolidate information on dangerous products and services.
- Publish and disseminate alerts, continuously monitoring their effectiveness.
- Monitor compliance with warnings related to dangerous products and services.
This law will come into force immediately upon its publication.
