By Supreme Decree No. 001-2025-TR , published on January 14, 2025 , access to maternity benefits under the Contributory Regime of Social Security in Health has been expanded for the benefit of affiliated pregnant workers.
What are the impacts of this new regulation?
- It comes into effect on January 15, 2025. Within 90 days, the regulatory instruments governing the recognition and payment of benefits will be adapted.
- Under Article 35 of the previous Social Security Modernization Law, to access maternity-related health benefits, the insurance holder had to meet two requirements: being affiliated at the time of conception and requiring a minimum of three consecutive months or four non-consecutive months of contributions.
- Under the new regulation of Article 35 of the new DS, pregnant workers (or their dependents) are immediately entitled to benefits from the moment they join, without needing to meet a minimum contribution period.
We recommend that employers verify the internal impact of this change, as well as maintain a communication and information channel regarding this new change.
