On November 5, 2024, the Consumer Defense Commission of the Congress of the Republic approved the opinion on Bills No. 8455/2023-C3R, 8543/2024-CR and 8633/2024-CR which, with substitute text, proposes to modify Law 30021 - Law for the Promotion of Healthy Eating for Children and Adolescents (hereinafter, the "Healthy Eating Law") and Law 29571 - Consumer Protection and Defense Code.

This opinion seeks to modify the following provisions:

  • Article 8 of the Healthy Food Act, which aims to prohibit juices or nectars whose ingredients do not comply with the Codex Alimentarius Standards for such products, from using images of fruit in their advertising aimed at children or adolescents under 16 years of age.
  • Article 32 of the Code, in order to establish that nutritional labeling on foods for human consumption is mandatory , and must be based on what is contemplated in the legislation on the matter or, failing that, on what is established in the Codex Alimentarius.

In this regard, the aforementioned opinion approved by the Consumer Protection Commission will now be subject to debate and voting in the Congressional Plenary.
